Do You Need a Permit for a Patio in Yanchep?

A patio joined to your house needs a building permit from the City of Wanneroo, whatever its size. A small freestanding patio or pergola may not need one, but it still has to meet the setbacks, which are the minimum gaps to your boundaries.

Usually no permit

A freestanding patio of 10 square metres or less and no more than 2.4 metres high doesn't need a building permit. Nor does a pergola under 20 square metres and under 2.4 metres high. The City counts it as a pergola when there's no solid roof, only battens (thin strips of timber or metal), lattice or shade cloth over the top.

Building permit needed

Every patio attached to your house needs a building permit, however small. If the patio doesn't meet the R-Codes (the state's rules for homes, such as setbacks), you also need planning approval, which is applied for with a development application.

How close to the boundary it can go

For most lots coded R20 or R30 (the housing density code the City gives a block), the City asks for a 1 metre gap from the side boundary to the post on a patio up to 14 metres long, and 1.5 metres on a longer one or beside a side street. The posts can sit on the boundary if the patio is no more than 10 metres long and 2.7 metres high, the roof and gutter stay at least 500 mm back, and it's behind the front setback.
