Do You Need a Permit for a Patio in Rockingham?

Most patios in Rockingham need a building permit, but a patio on a house in a residential zone doesn't need planning approval from the City of Rockingham.

A freestanding patio or carport up to 10 square metres and 2.4 metres high doesn't need a building permit. Nor does an open pergola at the house up to 20 square metres and 2.4 metres high. Both exemptions only apply outside wind regions C and D, the cyclone regions in AS 1170.2 (the Australian wind loading standard).

A patio joined to your house, or anything bigger, needs a building permit. The City doesn't ask for planning approval for a patio on a house, but it can check the R-Codes (the state's rules for homes, such as setbacks) as part of the permit.

Who holds the permit, and for how long

If the work is worth more than $20,000, the City issues the building permit to a registered builder. Every permit also has a clock on it: work has to begin within a year of issue or the permit is void, and finish within two years.
