Council Rules for Patios in Six Areas
Pick your area for its council rules on patios and the suburbs we cover there.
City of WannerooPatios Yanchep
Every patio attached to the house needs a building permit, whatever its size. Only a small freestanding patio, up to 10 square metres and 2.4 metres high, goes without one.Local rules and suburbs
City of JoondalupPatios Joondalup
A standalone patio up to 10 square metres and 2.4 m high needs no building permit, and an attached patio must sit at least 900 mm from a side or rear boundary.Local rules and suburbs
City of SwanPatios Midland
Guildford is a State Heritage Listed Place, so a patio there needs development approval, the City's planning approval, before any work starts. New building in a bushfire prone area needs a bushfire attack level (BAL) assessment.Local rules and suburbs
City of FremantlePatios Fremantle
On a heritage-listed home, a patio usually goes behind the main wall of the original building, screened from the street.Local rules and suburbs
City of RockinghamPatios Rockingham
On residential land, a patio on a house needs a building permit but no development approval. For work over $20,000, the permit is issued to a registered builder.Local rules and suburbs
City of MandurahPatios Mandurah
Jetties and mooring areas on the canals must not be roofed, so a canal-side patio stays on the land.Local rules and suburbs

Service area questions
Patios Across Perth: Your Questions
What people ask about getting a patio where they live.
Do you cover my suburb?
If your home is between Yanchep and Mandurah, yes. That takes in the whole Perth metro area, including the hills and the suburbs south of the river.
Which council approves my patio?
The council your home is in. The building permit application goes to that council, and some councils, such as the City of Fremantle and the City of Swan, have extra rules for heritage homes.
Are the council rules the same across Perth?
Not entirely. Each council has its own planning rules on top of the building permit. For example, the City of Fremantle has extra rules for patios on heritage homes, and the City of Mandurah does not allow roofs over canal jetties.
Is the measure free wherever I live in Perth?
Yes. The on-site measure and quote are free anywhere from Yanchep to Mandurah.
